    Quitting job while in Chapter 13?

    We are currently in our first year of Chapter 13. I receive a military pension and VA disability, my wife works. Her job has gotten to the point that she is on sleeping pills and anti-depressents. I'm not sure we can do another 48 months of this. If she quits/loses her job we will be under the median income, and be eligible for Chapter 7. We can get by on what my income is if we go Chapter 7. I just don't see the benefit of her continuing to work just so we can make those $1048 a month payments, and they just keep going up. Right now all the payments are paying is the attorney and the car. I don't have a problem giving up the car.
    Has anyone quit their job while under Chapter 13? I have emailed my attorney 3 times with no response. His Paralegal said it only takes 100 days to be finished with a Chapter 7.

    What do you mean that the payments are $1048.00 and keep going up? Is your plan not confirmed?

      Why did you file chapter 13 in the first place?

      In any event, a chapter 13 is not supposed to be indentured servitude. She can quit her job, however, you will need involvement from your attorney to make this work smoothly. The court is not simply going to allow here to quit and then convert to seven. Typically, the court will grant a temporary payment forbearance (or lower the payment) to allow her to find another job. If, after 3-4 months, no new job materializes, then you have "changed circumstances" that justify a conversion to a chapter 7.

        My husband didn't quit his job while in our CH 13, but he did have to go on disability, first temporarily and then permanent disability retirement, which changed our income drastically. As HHM said, first they gave us a 3-month forbearance on making payments, but since his disability didn't miraculously heal itself (gee... he'd been on temporary disability for over a year before he could get permanent disability, during which time they wouldn't change the payments because it was "temporary" and then when it became permanent wouldn't change for 3 more months...) but anyhow, finally got new plan submitted with new income figured in. It's been 34 days since that went in to the judge, she still hasn't ruled on it yet, and we've made the higher payment for 2 months now... so it isn't a quick or slam-dunk process. But it may eventually work out, I hope! (for both you and me!)

        Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!
