    Vehicle insurance......

    I filed ch 13 in April 09 agreed to give back the car...plan was confirmed last week... have not paid for the car since February... they are taking there time coming and getting it....it is parked expired tags won't even attempt to drive it... so my question is...am I still responsible to keep insurance on it until they come get it???? or is it their problem and responsibility now...I want to take the insurance off but am afraid if its stolen or vandalized I will be financially responsible......Thanks

    As long as the car is titled in your name, you are responsible for insurance on that vehicle. However, since it is parked and not on the road, in order for the insurance to be removed you would have to turn in the tags to your Motor Vehicle Dept. so that it cannot get back on the road without insurance. If your state requires auto insurance for vehicles on the road (I don't know one that doesn't), if you move that vehicle and get in an accident where someone is hurt or there is a large amount of damage, you are responsible. Once the title changes names you are free from insurance responsibility. call your Motor Vehicle Dept. for specifics for your state.

      Flamingo is correct as usual but I must add, if you do wish to drive the car, pay the tag and until they pick it up, it is your car. 'Hub

        Monday, I would call the Company who holds the title to your vehicle, ask for the Bankruptcy Dept. and make them set an appt. to come get the vehicle. Be persistent. If they don't pick it up Monday, call them again on Tuesday. I would call them every day and bug the pee wad out of them until they pick it up.

        Yes, you want to keep insurance on the vehicle as it is in the same spot. A child could be on a bicycle, run into it and be hurt. That's when you need the automobile insurance. IF you are not going to move it, call your insurance agent and get the 'bare minimum' insurance required to make sure you are covered if something should happen to the vehicle.

        I know this is very frustrating. I made phone calls every day for 2 solid weeks last Nov. until they finally came and got our Motorhome which we voluntarily surrendered. The insurance was $125 a month and we were hurting for money.

          I had a car that was being paid by the Trustee through my plan when my case was first filed. Later on in my plan, I was given permission by the courts to incur the debt of purchasing a newer vehicle, and surrendering my other one. Since I wasn't driving the one vehicle, and waiting for them to pick it up, my attorney had told me that I only needed to keep comprehensive coverage on it, which would cover theft, vandalism, etc. To be on the safe side, you should ask your attorney.
