    341 went well!

    Hi!

    Just thought I'd let you all know how my 341 went. We had a 10:00 a.m. hearing appointment and it ended up that we were in a group session meaning that we all had the same hearing time. Anyway, I got the opportunity to watch about 15 cases before mine was called and I have to say that ours went the best. Basically, we were asked all of the standard questions (identifications, taxes, mortgage current, child support, etc). The only thing the trustee asked outside of this standard stuff was to provide a copy of the recorded deeds of trust on our mortgages. She glanced at the paperwork my attorney provided and took down notes and then asked if there were any creditors present (to which there was not) and we were done. That was it!

    But before us, the people were asked all kinds of things and me and my husband were preparing our answers to the questions asked of them (i.e., what did we spend our tax refund on this past year, etc.) But alot of them had child support issues, had filed BK several times, and had other legal issues. So ours was a piece of cake. Now we are in the 60 day window waiting on confirmation. Yeah!

    That's great! I hope the next 3 years are as smooth and uneventful!

      Did your projected payment of $125 get confirmed too?!?

      May 28th - Filed for Ch 7 (FINALLY!)

          It wasn't even mentioned. The only thing with regards to payment was today (2 days after the 341) and our lawyer called my husband and said he was going to amend our paperwork for 36 month plan. We told him that was what it was all along and he agreed. Don't know if there was confusion over ours being a 3 or 5 year plan but it is definitely a three year one from the conversation today. We were so close to the median income (only $800 for the year) so I'm not really surprised.

          Let's hope the next 3 years go as well. I'm really trying to be thrifty and save every penny I can for emergencies and car break downs. Like today, I washed my car in my yard and I haven't done that in years (usually I take it to a car wash) and I have started clipping coupons. Things are really changing!

            I understand what you are saying. My attorney said to be prepared for that to happen as it does happen in about 95 percent of the cases. So we shall see what will happen next. Best wishes to you.
