Basically, based on our income, a 13 is the way to go..which I already knew thanks to this forum.
She estimates my payments to be about 800 a month. I can live with that. She went through all our expenses and income. Looked at what we owe and answered all our questions.
I did tell her about how I did make a cash advance in May and asked if we should wait the 70-90 days to file. She said that if we were doing a ch 7, then yes, we would have to wait, but not with a 13 since we are "repaying" a portion of it. (this is because all our money will be going to unsecured debt..we are not trying to catch up on any mortgages or car payments).
She said to stop paying the credit cards and if we pay the $150 retainer, then we can direct collection calls to her. The fee would be $850 up front plus the $274 filing fee. The rest of the $3000 attorney fee would be rolled into the bankruptcy payments.
We would have loved to sign right away...just get it over with, but we had severe issues with my van and had to pay $700 to fix, LOL. So we have to save up again to pay for the filing. Im assuming we can do it by the end of the summer. I am very proud that we paid for the van in CASH that we had saved. Of course, we depleted our savings, but at least its paid for and not on a credit card. We have never done that before.
I feel relieved the first two steps are over with...(the first attorney meeting and the credit counseling). Now to save up to actually file, LOL. I have a feeling it will be a very long and hard 5 years, but its better than spending the next 30 years paying interest on a mcdonalds run I made in 2007, LMAO!
