If I have a confirmed CH 13 which I filed separately from my husband. Can he file a CH 13 at a later time or is that not allowed?

He can file BK, but his case could get a little thorny if your Chapter 13 is still open. I wouldn't suggest dismissing your case and refiling a joint case, but if he has to file a chapter 13 and your's is still open, it will probably be beneficial to request to have the cases jointly administered and amend your plan accordingly.
