hopeforus is correct, as long as the cars/house are included in your repayment plan, you should be okay. Both our cars and the house are included in our repayment plan, and I must admit it has been a big relief on us. Keep your head up and don't worry, the creditors cannot come after you since the automatic stay is in effect. However, you have to be careful with the mortgage -- this will have to be kept current after filing or they can come after you, but the amount that is in arrears at the time of filing can be included in the repayment plan. The way our plan is set up, both cars will be paid off in the plan, and the arrearage on the house will be paid. Because we were behind on our house payment when we filed, the trustee has to make the monthly payments while we are in bankruptcy (local requirement). The trustee gets paid more this way, but I like it better because I don't have to worry about the mortgage being paid on time for the next 4 years, because I know its already covered in my ch. 13 payment. You have to do what's better for you in your situation, but I'm sure everything will work out. Make sure you talk to your attorney, and let him/her know what you feel would be better for you and why.... your attorney is paid to work for you, so make sure you have some input. Good luck, and keep us posted!!!Filed Ch. 13 Pro Se 1/8/09
