    wage garnish or direct pay?

    ive got my " meeting of the creditors" on may 8th so im getting closer

    i was wondering though....in my last meeting with my att he told me what my pymt would be and that after making the first payment or maybe 2 that they would start taking a little each week out of my check to equal the monthly amount, but when i got all my paperwork yesterday in the mail it just said they would take the whole amount out at once each month. Do you guys that have it garnished have it divided by 4 and have some each week or just once a month? Just curious

    First, it's not a garnishment, although it behaves the same way.

    Usually, the wage deduction will be based on your pay period. If you're paid bi-weekly, then they will deduct the bi-weekly payment from your check (the formula is not simply "monthly payment" divided by 2). If you are paid monthly, then it's monthly. If you are bi-monthly, then they will divide the monthly payment by 2. That simple.

    Re-read the paperwork. It may talk about a monthly payment, but have a "per pay period" statement as well. (Mine has a monthly on the Motion for Entry of Wage Deduction Order, but also has a semi-monthly payment amount for each pay period. I have two pay periods per month as I'm paid the 15th and last day.)

    If you are paid weekly, I'd ask your lawyer why it reads reads monthly.

      I get paid bi-weekly and my payment is taken out of each paycheck. Works out to $1850 per month. This has worked out great for us as it is one less thing that I have to worry about. Our plan has allowed us some breathing room each month, so far, even after all bills are paid.

        Thanks for saying your plan has given you some breathing room. So often folks only say how awful it is

          BTW, my plan is not awful. I have breathing room... but I seem to keep breathing.

            wel, i talked to the att assit today and she said even though it says "monthly" in my paperwork, it will be divided by like 4.3 or 4.4 and taken out each week. Im glad they are doing that....seems like it will be easier than mailing in a pymt every month
