We are still trying to figure how long before our tax refund for 2008 will be received. Chapter 13 successful discharge as of Jan '09. Filed 2008 return on 3-23-09. Due to be direct deposited by 4-03-09. Checked status on refund on 4-04-09 and showed "delayed". Have attempted literally over one hundred times to contact field office where my case is assigned. No luck. After getting bounced around on the phone, went to the Ft. Worth IRS and waited over 3 hours to speak face to face to someone. The way I understood her is that ONCE I filed for bankruptcy, the collections were suspended. Now, I have received (2) separate collections for back taxes owed and I am CONFUSED. Did my attorney negotiate all the outstanding debt with the IRS on my behalf? Do I still owe this money? Is this an example of how slow the IRS system is to close out my account once I have been discharged? I am discouraged after struggling over 5 years and not missing a payment only to have my refund held up. How long will it take to resolve my issue?

I am assuming you paid off the IRS debt for past taxes due with your Chapter 13 plan. Prior to your discharge, your trustee sent out all remaining payments to all creditors. If you received your discharge, all is well and your matter should be closed shortly. Did you have taxes due for other years after you filed and did not pay them? Get a refund? Refund intercepted by Trustee? We need more information from you._________________________________________

I assumed that my attorney grouped all back taxes into the plan. I have not received a refund until I filed my 2008 taxes. The past years during the plan, I have had to pay in. Even my stimulus payment I qualified for in '07 was applied to the plan. It is nerve racking to hear different interpretations by the different IRS reps I talk to. The rep I spoke with in person today could only tell me that all is not done until the IRS discharges any taxes that were part of the Chp 13 plan. As of today, they have not.
