Met With Lawyer Today Looks Good

My Case

State: Arizona

I will file own my own not including spouse

Own home with wife. Home was in her name long before we were ever married or met. No big deal

Credit Cards $40,000

Monthly payments $900

I met with my Lawyer today for the initial and feel the weight lifted from my shoulders. He seems to think that a 13 will be no problem. Currently I'm paying over 900 a month in CC bills and have used the cards within the last 60 days just on crap stuff. He just shrugged his shoulders and said don't worry about it, just don't use them anymore. Cost is gonna be $1500 up front with 1500 inclueded in plan, total $3,000. I should end up seeing a payment of about 200 a month for I'm guessing 5 years which will be a huge releif as each one of my cards has been raising their rates.

I'm so releived it really took a load off just going and talking to the attorney and actually hearing him say don't make another payment to any of them.

Glad you are feeling better about the situation. I was just wondering, Arizona is a community property state, will the creditors come after your wife? Is she on any of the cc's with you (authorized user/cosigner)?

Not on any of the credit cards with me. Even though Arizona is a community property state there are exceptions when one spouse owned the house or property or assests well before the marriage. However any debt aquired after marriage is considerd both parties one spouse can still file on it. As the attorney stated to me the new law didn't fix everything.
