    Happy Day, Judge approved 3 month suspension of payments

    Just saw on Pacer where the judge approved my attorney's motion to suspend our payments for 3 months while hubby's disability paperwork gets finished. (He got approved while we were waiting more than a month for the CH 13 trustee decision, although there's still some paperwork issues that will keep him from getting his first check and back pay until mid-May). We already paid for March (payroll deducted) so I'm not sure whether we need to do anything to get that back since suspension is good for Mar-May or if the trustee will just automatically send it back to us now. I've checked on the CH 13 datacenter and he's still not showing getting the check, even though payroll sent it on April 24th, which is longer than it usually takes to post, so I'm wondering if he's just been sitting on it knowing that the motion to suspend was in the works?

    Anyhow, it's still a tight month since hubby hasn't gotten a check since Feb 18, and 1/3 of my check went to the trustee, but if they send it back soon, things will work out ok (and we have savings if we don't get the check from trustee soon, but I just hate to dip into it for anything!)

    No one said Ch 13 was going to be easy! but usually things work out. (knowcking on wood!)

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

        Called the lawyer today to find out when we should expect our reimbursement for March payment, she said it usually takes about a week. Need to get the judge's order of suspension over to the people in payroll so they don't take $ out of my next two checks too (I get paid monthly). Hubby just talked to the State Disability people, they said that he should get his 1st check (which will include back-pay from March 1st on) about a month after they finalize the paperwork at their next meeting, which is April 15th, so we should get 3 months disability pay mid-May. I was really hoping we could use this disability thing to get converted to a CH 7, but looks like we're going to be doing the 13 thing for the long haul (we've got 18 months in already).
