    Confirmed today!!!

    Just checked PACER, and our ch. 13 plan has been confirmed!!! WOO-HOO!!! It has been a long 2 1/2 months, but we have finally made it. I just want to thank all of you who have contributed to this forum. You have no idea how much of a help you have been to me & my husband. It took alot of reading of the bankruptcy laws/code, nolo book, and this forum for us to even get through this, and I just want to express my heartfelt thanks to all of you. We may only be at the beginning of the plan payments, but it sure feels good to have some peace of mind again!!!

      Great news on your confirmation!! CONGRATULATIONS!!

      Now you can relax, always make your payments on time, and stay under your trustee's radar.

      Your first priority - if you haven't already, open a savings account and start setting aside any extra $$ left over at the end of the month to create an emergency fund. Life has a way of delivering unexpected bumps over 60 months - an emergency fund is the only way to survive them until you are successfully discharged.

        congrats on your confirmation but you might want to confer with your attorney
        your 48 months begin usually at your confirmation date not filing date first 2-3 months are freebies to the system, I got filed on June 1 2006 confirmed August 31 and that's when they began counting my 36 months

              Thanks Abbey, but the 2 months already paid into plan do count towards plan payments -- its specifically spelled out in the confirmation order. Your initial 2-3 payments may have went towards you attorney fees, which usually are paid first, or it may be different in the district you live in. As you can see, we filed without an attorney, and therefore have no attorney fees being paid through our plan. The trustee just does not make any disbursements to the creditors until the plan is confirmed. This would also be the case with people who had delayed confirmations due to objections, etc. Thanks again for the well wishes...

                  We're going to be filing within the month. It looks like you started making payments before things were confirmed. Is that normal? With no experience I would think you didn't pay till things were confirmed and everything was all agreed upon and accepted as such.

                  Are we allowed to just mail a check to the trustee monthly or how is payment handled?

                        You have to begin making your proposed plan payments withn 30 days of the filing date of your bankruptcy. The plan payment may change, depending upon the trustee and your circumstances, but regardless, the first payment must be received within 30 days of filing, and every 30 days thereafter. Otherwise, the trustee could move to dismiss your case. The way payments are handled depends on your trustee; some want only wage deductions, some money orders/certified checks, & some will accept ACH debit. It just depends on the trustee in your district. Whichever lawyer you choose should be able to tell you the preferences of the trustee in your area. Good luck with everything!!!

                          We had a wage attachment put on our wages even though we ask multiple times if we could just send the payments monthly. We were told if you have regular wages there has to be a wage attachment. Mine have already started even thought the trustee is still determining what amount we should be paying. From my point of view they want us to be broke every month after we make our plan payment.

                              Each Ch 13 trustee picks the payment methods they allow. There's no consistency across the country. Your trustee happens to be one that requires the payment be automatically sent directly from your employer to the trustee.

                              If there is a compelling reason that your monthly payment can't automatically sent by your employer to the trustee, it is possible for your lawyer to request an exception from the bankruptcy judge. But the reason has to be a good one - like your employer isn't set up to provide this kind of direct payment structure or isn't making your payments to the trustee in a timely manner. It can't just be personal preference.

                              Mine have already started even thought the trustee is still determining what amount we should be paying.
                              This is how Ch 13 works. You start making payments that match the payment proposed in your plan within 30 days of filing, and keep making those payments until your plan and final payment amount are confirmed. This is the way it works for every Ch 13 filer. It's nothing personal directed at you.
