341 today

We had our 341 today. Our day started at 4:30 up (well never really slept) dropped daughter off at daycare at 6:40 then made our way downtown to the court house. On the advise of everyone here we did a dry run yesterday to see what construction was going on and where to park so we had no suprsises this morning. We arrived early and I am so glad we did. Our attorney met us early as well our appointment was at 8 am we were scheduled # 33 out of 35 for the 8am appointments. When we checked in we were told to go to meeting room 2. When we entered it was the rest of the 7:30 appts that were actually continued 341 hearings. There were about 5 couples and us no lawyers were present. The lawyer for the trustee kepts asking if attornyes for xxx were present said no and moved on. Suprisingly at 7:50 they called our name and we sat down. She stated that it was before the 8 o'clock hour however we would conduct our interview and if not finished before 8am we would have to wait and she would recall us to make sure we did not have a creditor objection. We were out of there at 8:02 woohooo!!

Everything went smooth just a few objections (we were aware that they would object to atleast 1 thing as it is standard procedure) they asked for proof of daycare exp 715 per month (understandable) the one objection we were expecting never came and that was the 400 per month medical. Guess you can never be sure! Anyway I was happy and now we wait.. We are doing a lien strip and our attorney is filing the motion Friday so things are moving along.

Wow so much worry for nothing I sure am relieved that is over!

That's great news, I am so glad it went smoothly for you. Did you file chapter 7 or 13? Were you under or over median?

We are over the median and filed chapter 13.

I felt so sorry for those people just sitting there and no attorney showed up, I would have blown a gasket.

I will die if my lawyer does not show up! He told us during the first meeting that he would be there. Did your attorney answer questions? What role did he play at the meeting?

He pretty much just took notes and any documents they stated they did not have he said he would get right over.. needless to say all docs asked for have previously been given and filed with the court. He said this is a common occurance. They were looking for some paystubs so no big deal!

All questions were asked directly to us and we answered, mostly confirming information they already had. It truly was no big deal, I wish I had taken the time to go to the courthouse earlier just to listen so I could have set my mind and nerves at ease.

Hi Eddie:

Many lawyers don't show up; they send assistants or no one at all. If you have been prepared well by your attorney (and reading this forum) you will do fine. The biggest problem is figuring out how NOT to worry.

Our Trustee would not take the debtors without there attorney being present they had no choice. She said she would either give them a continuance or they could hang around and wait for the attorney to show up and if the calendar permited she would try and squeeze them in.

Eddie - don't worry about it, there is too much to worry about in life. All will go well! When is your 341?

Congratulations on making it through your 341. We always blow it out of proportion in our minds and then it is nothing.

To Eddie:

You will do great. Answer very clearly yes or no. If your attorney said he would be there, then he should be and if he is not then ask for a continuance. You are represented by counsel and have paid for him to be there. Good luck! It will be fine.
