    pay stub question

I received a letter from my attorney saying they want the last 2 months of paystubs withen the next five day. I did get filed with the court on Thursday. I found all of them except for one , which the week ending on it would be 3/5/09. I do have the ones before and after that date. Is it ok to send them all in except the one? Thanks again

Only your lawyer can answer that.

You must send every single one of them. Absolutely required. Cases have been dismissed where the person received the same exact amount of money, every single pay period, but missed filing just one of them.

Contact your employer tomorrow (MONDAY) and get a copy of the missing one. Don't let your case get automatically dismissed on a technicality.

In the interim, get the ones you have to your lawyer TOMORROW (Monday) and let them know you are going to get the missing one in the next two days. Follow through. Get it done.

BTW, As fltoo suggests, talk with your lawyer. However, I'm not your lawyer, but your lawyer will probably tell you exactly what I just wrote. Get on top of this. Notify your employer that you need that duplicate tomorrow morning. Do not delay.

I had this problem, because my trustee required 6 months worth of pay stubs, not 60 days, and I was missing 1 from much earlier before I was considering filing BK. My payroll department said they didn't make duplicates, but did do a print-out of all my payments over the previous 6 months and the judge took that in lieu of the one missing pay stub. Your payroll department should be able to get you something that would serve as proper verification of your payment.
