    New here - a thank you - and my story thus far

    Hello everyone,

    I have been lurking for about 2 months now and just want to say that I have learned so much about this entire process from you wonderful people so thank you from me and husband from the bottom of our hearts.

    I have quickly learned that bk is a taboo subject and since I am such a talker, it's hard to keep my comments and thoughts to myself - but I am learning. It's great to find a community of people who have walked the path we are about to embark on and to see that you can do so successfully.

    Long story short, DH and I find ourselves needing file bk. We are pretty sure it will be a 13 but our wonderful attorney is investigating whether we can qualify for a 7, we'll see. Thanks to this site, we have been able to do some pre-bk planning and put some strategies in place such as purchasing a new vehicle before our credit totally tanks. We were surprised and quite pleased that we qualified for 1.9% interest on a 2009 vehicle so we will not have to worry about that for five years.

    I do have a quick question. We received a letter in the mail from AmEx regarding our account. We owe about $20,000 and when we first fell behind I asked them for help and it was a no go. Now all of a sudden after 2 months of no payments they want to restore our original low interest rate, waive late fees and work out a payment plan to bring us current so that we can continue to use the card. I haven't spoken with our attorney yet though about this latest development. Is this common to get these offers from creditors?

    It is quite common for them to want to get money from you any way they can. If you are going to file, I would no longer make any payments to AmEx. They will be included in your bankruptcy and why throw away the money. Plus, if you are filing you don't want to be using any cards anyway.

    My advice....let it go. Don't pay them anything, include them in the petition and save your money for attorney's and filing fees.
