    To those of you who have to surrender tax refunds to the trustee...

    My plan says IRS refunds over $1602. I have been trying to get answers from my lawyer on whether it is just Federal refunds above that amount or if it includes state refunds too.

    Anyone else in the same boat?

    IRS is the IRS is the IRS in my eyes, meaning, add both your state and fed tax refunds up.

      We have to surrender any amount over $1000. You have to add your state and federal together and pay anything over $1602, in your case. We just sent a check for $6350 to the trustee yesterday. That hurt. Federal was $6496 and state was $854.

      You can bet there will be no more refunds over $1000 for us.

        Ouch Erica...that would be hard to send that amount of money. Although I thought about it and if I wasn't in bk I would have sent my refund to creditors anyway. I would love to change my exemptions but my paperwork says you cannot change exemptions without trustee approval.

          Really. We changed our exemptions right after we filed and figured out that we have way too much withheld. It was very hard to send that check.

          Look at it this way...you just pay more off in the end....HaHaHa...
