Did some of our accounts get sold after we filed Bankruptcy 13?

    Did some of our accounts get sold after we filed Bankruptcy 13?

    I noticed the other day 3 new creditors were added to our list. The name of the creditor is JEFFERSON CAPITAL SYSTEMS LLC. They are junk debt buyers and they pursue and purchase bankruptcy debt. We never received noticed from them that they had purchased any of our debts. They just showed up on their own on debts we owe on 13datacenter.

    My question is: if a person files bankrutcy Chapter 13, can a creditor sell the debt without notifying us that they did?

    Yes, and I don't see any reason why they would have to notify you.

      My 13 was filed back in May of 07, and so far, I've had two creditors that originally filed claims, sale the claims to other creditors. It is called "transferring of claims." The only notice I received was from the BK court telling me that they allowed the claim to be transferred.

        I guess they don't have to but it would be nice to find out who they bought it from. I hope the original creditor does file a claim also.

          Have not received any 'transferring of claims" notice.

            All but 4 out of 23 of our claims are with some collection agency, even though none of the debts were late when we filed our 13 29 months ago.If we were ever to dismiss our case and try to settle with these collection agencies, I`m not sure if we could do better than the 80% payback we are currently in. In experiences out there?

              I suspect the BK filing causes the lender internally to charge off and sell the receivable. Two possibilities come to mind, one is that it is related to securitization and the other is that the lender doesn't want to show non-performing loans in their portfolio, it's embarassing.

                I've had several claims made by junk buyers. If you look at the claim in Pacer, you may find the sale document there. All of my claims in Pacer have documents supporting the sale of the debt.

                And to add, these were all purchased AFTER we filed.
                Filed CH13 12/31/08, abandoned March 09 after losing job.

                Ch7 Filed March 2010. 341 Meeting April 2010. Discharge and Case Closed July 2010.

                  In 13datacenter.com, if you click on the claim number, somewhere in the notes it will say who the originator was....just in case you really want to know. We have them too, and I believe it is who HSBC sells to.

                    Checked today and this one buyer has bought 4 of our loans so far. The loans are from 4 seperate creditors which makes me think the buyer might be contacting the creditors.

                      Could be. We have 17 claims filed so far and 4 of them are from the Jefferson place. Some people deal in that stuff. No biggie.

                      I did go into 13datacenter and if you click on Claim Summary and then the number it will give you info about the claim. For mine it is the last for of the original a/c # and even the name of the card. Make them prove they own it. They have to anyway if they want to get paid.

                          Out of the 17 that have claimed so far....only 3 are the original lender...the car (Ford), the student loan (Sallie Mae), Target card. Amazing how they just dump it off so fast. Wonder if the other 25 or so will file. They only have until May 5th. I hope they forget...

                            One of the original creditors is Chase. Even though Chase sold the account, they are still reporting it on my credit report.

                              And they can, but there is usually a notation that they sold it to collections. Unless the collection agency they sent it to is in house. Capital One and NCO Financial Systems are in bed together.

                              Oh well. Credit is in the pooper for awhile anyway.
