    Confirmation hearing March 5th.

    Hi All,

    Our confirmation hearing is on thursaday March 5th. Our atorney feels confident our plan will be approved. Any stories good or bad about your confirmation hearing? Could the trustee flat out dimiss for whatever reason? Or, would the attorney ask for a continuance?

    Confirmation hearings are boring, for the most part. Most of the time they just check that there are no outstanding objections to the confirmation and/or claims. Then if you're paying on time... confirmed.

      Ours was pretty easy. We had just a few objections to begin with (medical, auto, food). We turned in all receipts that were requested and just waited. Even though the lawyer said we shoudl be good, I have to admit I was extremly nervous. Those nasty objection letters can really lead you to believe your case will be tossed. Our trustee even went to the point of contacting my Dr's offices for proof of the expenses I turned in.

      If your atty feels good about your case - then you should be ok.

        @ insomniac, were you over or under the median, and also, were the amounts you claimed for food, auto, medical excessively over the IRS standards and or trustee guidelines?

          Not to butt in... optimistic... I went over the Federal guidelines in two areas. First was for home energy (which was easy to justify last year). The second was on my telecommunications expenses. I could justify my Blackberry as "income producing" and the lack thereof, would mean less money for creditors.

          Now the food one is very very specific. You can only go over food and clothing by 5%. Otherwise, you need a specific medical reason for going over. It can't be because you like Prada.

            LoL @ prada. Ok, all of my expense claims are below the Fed standards, and the Trustee guidelines, I dont see any issue, other than objections that it is not feasible, (crossing fingers).

              I will cross my fingers for you as well... that they don't file a bad faith objection.

                We were over for medical and auto. We spend between 300 and 400 each month on out of pocket medical which is what is really killing us. Auto is high due to a long commute for me. Between my wife and I we average $150 / wk in gas. We were within the limits elsewhere, they had just initially left our 3 kids off the list on accident which cause more "red flags" than necessary. We were able to prove these and the trustee quickly moved for confirmation.
