how long do i have to keep a low profile in my ch 13?

    Before we converted our 13 to a 7 we were told that if our income increased on our tax refund more than 10% we had to let them know and they would raise our payment. They looked at our tax return every year. Claiming extra income when you do your taxes might not be the way to go.

      The older section of this thread from last February is the possible fraud account. The renewed posts after that just state the Ch 13 filer is wondering if it's ok to open a savings account after filing.

      What worries me is there's a tendency to think that ANY cash in a savings account that collects during Ch 13 must come from additional income and therefore must be given over to the trustee. Well, extra cash in Ch 13 doesn't necessarily come from extra income. The extra cash can come from keeping strictly to a budget too. Also if the Ch 13 trustee allows keeping some or all of a tax return yearly, that can go into there as well. Money gifts for birthdays, holidays, etc are ok too.

      Our lawyer was quite specific that it was fine to have a savings account while in Ch 13 as long as the extra money didn't come from an undeclared second job, an undeclared inheritance, etc. We try hard to put any and all leftover cash at the end of the month in the savings account. That's our emergency fund and has saved our bacon several times already.

        im not trying to commit fraud im just finally making enough to save money in a bank account now since i moved out of state and im making more money.

        all i wanted to know is if theres a cap in which the 13 trustee will be asking for more money or something. im not making that much more im just able to save more since i a splitting bills with my bf.
        filed ch 13 june 4th 2008
        total payback: 10 G over next 5 yrs.

          It would benefit you greatly so you know what to do as to your own Chapter 13 Plan to call your attorney and mention the amount of additional money you are making and what, if anything, you should do. It appears your expenses may have decreased also if you now have a boyfriend helping you with your bills. You have a decrease of expenses and an increase in income. So you have a major change of financial status during your Chapter 13. Call your attorney and advise.
