    Payday Loans

    Hi Everyone,
    First I would like to let everyone know that I appreciate this forum, I am learning more and I read a pots on here (somewhere) that "knowledge is power". I love that!
    My DH and I have appt w/lawyer this Friday to give him our info and retain him.
    I know that I can ask him about the Payday loans at our appt, but does anyone have any experiences with these in BK? I have been going to 4 locally for over 2 yrs off and on. I am into each of them $600 right now and have been paying them faithfully every two weeks. At the consultaion the lawyer said if we intend to file go ahead stop paying everything except the secured loans, house, car, etc. Would this be considered a secured loan since they have my checks??

    No, they are not secured. I filed on some; my attorney said he'd welcome them to try to fight it (my case) in court--the judge would laugh them out the door. They are the worst kinds of scumbags in legal operation, in my opinion.

    Anyway, be prepared for them to harrass you by phone until you have a case number to give them--but start with giving them your attorney's name and number, once you retain him/her. Best of luck!

      I included a payday loan in my BK. I just ignored the calls until they received the letter. Then they backed off of me but they did put in a claim and they are getting 32.5% back!

        We included 5 (2 of which we had done online). Only 2 filed claims.

          We filed on 3 of these places. One thing the lawyer did tell us to do was to close the bank account the checks were wrote on. These places can cash the checks if they do not get paperwork from attorney in time. Then the bank can have you charged with writing bad checks. We stopped that day and closed the account. Better safe then sorry!!

            I was told the same thing and closed my account and opened a new one. My attorney told me the courts don't think too highly of these payday loan places. Close your bank account immediately, stop paying on the loans and save your money to hand to your attorney.

              I hate to even admit this, but I really wanted to go get one of these because I knew I would end up filing anyways. But, that would look really bad! I decided not to......

                I have two accounts, closed one that were attached to the on-line payday loans, I didn't mention those in the original post but they have been cut off as of last week. I am more concerned with the local ones right now written on my account that is still open. It takes time to have payroll check redirected to a new account so I think I will stop payment on the checks for now and hand them my attorney's info on Monday morning! Thanks for your feedback, I feel like there is finally a light at the end of this tunnel! I better get my paperwork finished up for the attorney tomorrow...uugghh

                    Have tried to open two checking accounts on-line...I was denied. I will see what our lawyer says tomorrow, thanks for your feedback, I am not as nervous as I was earlier!

                      One more note.....if not for what we are shelling out for these, we probably would not have to file.....one very huge lessoned learned!

                        Can payday loans put you on a chexsystems type reporting agency?
