    Paid Attorney today in Arizona

    This is a first in my life, having to file for BK 13, but I became disabled three years ago and my husband lost some health insurance that covered some expenses related to that... We've been floundering since then, barely hanging on. What sent us over the edge was Wells Fargo and they allowing my debit card to run up fraudulent charges all the while, my begging them to turn off my debit card. Nearly $4000.00 later over five weeks, it was finally shut off. The kicker is, it wasn't due to my asking for it, it was due to it being used to overdraft the account too much. DUH!

    Anyway, we were never able to recover from a loss of half our income over a month's time and never caught up again. We live in Cochise County, AZ, but the courts here don't handle BK so everything will go to Pima County.

    We have no idea what's going to happen in all of this, never having done it before and I was hoping some of you could help us understand this better. The attorney did say he was going to do an emergency filing since we got a certified letter in the mail yesterday. Don't know what's in it as we haven't gone to the PO yet to get it. Also, we found out in all of this that my husband's arrearage with Colorado CSE was reduced to a judgment in 2003. The debt can and will be included in the BK and there's a strong possibility it will be discharged due to her stupidity and CSE's no longer being legally able to represent her since the kids are now emancipated and have been for some time. (and before anyone goes on a rant, it was a created arrearage due to his ex taking him to court once a year, just like clockwork, to raise the child support and the court taking SO LONG to do simple math)

    Also, I was just telling the attorney today about a company that is creating fraudulent bills in my husband's name and we can't seem to shake them, no matter what we do. The company is named Palisade's Collections and they keep trying to collect three "phone bills" from Verizon North (a company we haven't used for, oh, nearly five years and when we left them, we owed nothing). The bills are for $2300, 900 and 600. When they put these bills on his credit last year, we filed a fraud report with the police as my husband has a security clearance. We used this phone company for six years while we lived in Ohio and never had a late bill with them, much less three of them totaling almost $4000.00.

    My primary question related to this wonderful collection agency is, what can/will the attorney do about these guys? We shouldn't have to pay debts we don't owe but if it shows up on hubby's bureau after we file, we might have to do just that just to get them to leave us alone. The debts are no longer on hubby's credit but they could reappear. Also, this collection agency seems to do this quite a bit, create bills in names of people, I guess hoping to get "some' money. Last year, I even contacted the FBI about them and am considering doing it again. This is our fourth foray with them, they rear their ugly head about twice a year, over the last five years. The amounts are always different, always with the same account numbers. At one time, they tried to say we owed over $10,000.00 and they would be happy to settle it all for $1500.00. We usually ignore this stuff and it will go on the credit bureau, but then disappear a few months later.

    oh, and what pushed us over the edge into filing? I had a CC with Wells Fargo and about a month ago, I was at a cancer clinic getting a treatment when they called me on my cell. Thinking it was a family member, I answered it. The guy started to harangue me and I said, "I'm sitting in a chair right now at a cancer center getting treatment and I can't discuss this right now." His response? "Oh, you can pay for your cancer medications but you can't pay your credit card bill?" I hung up, called my husband and said, "Today's the day we call a lawyer." When I told him what happened, he was LIVID!

    These guys have me worried, though, with a BK looming on the horizon. Any advice?

    relax and get well. Put absolutely everything in that filing. Pull your credit reports and make sure every collection, medical bill, even if it was from YEARS ago is included in this filing. Leave no creditor stone unturned. Make sure you have all courts covered as well just in case there are judgments out there languishing.

    Then concentrate on your health and getting better. Make your trustee payments and begin your new start.

      Thank you so much gramma for your good wishes. The filing of the BK is to provide peace of mind so I may concentrate more on getting well and less on the possibility of losing our home. I was diagnosed the month after we closed on our house and it's been a struggle ever since.

      I'm just worried about this whole Palisades thing since the three accounts they say we have are obviously fraudulent but something has to be done. People with access can put whatever they want onto your credit bureaus.

      I hate Palisades. Everytime the FTC shuts one office down another opens up using the name of a different "attorney".

        your filing will stop them from continuing to harass you. And once you file, dispute your credit report to have them report as IIB/zero balance. Just make sure you include ALL of the pallasides accounts (check account numbers to see if they have different numbers for each account and make sure you list them each time separately so there is no way they can claim that "particular" account wasn't listed.
