    It might not specifically list it. And it would be up to the judge to decide and interpret the laws.

    If your intent is to all of the sudden start contributing money to charity, to decrease your amount that would go to the creditors, and the trustee calls RED FLAG. Then you will need to justify why you all of the sudden want to start donating.

    The trustee's argument will be, you might say that you are contributing, but then what if you stop after 6 months, and then start buying DVD's instead, or gambling, or etc.etc.etc.

        Again, as I mentioned in my posting this a.m. in a question posed concerning contributing to 401(k)'s during a Chapter 13 plan, the majority of folks prior to filing are in such bad shape they have stopped contributing to everything if they did donate, including the church, charities, buying Girl Scout Cookies, etc., etc. If you have stopped doing that and then all of a sudden you want to give $25 a week to your church or other charity, it can raise eyebrows. Go one to one with your attorney on this for your specific situation. In our situation, we are Catholic and gave to our church on a weekly basis. When the job loss hit, of course we could not anymore. We called our pastor, explained the situation and were told that is fine and when things were better for us to contribute again. It was not the end of the world and when our Plan was done and we were in better shape we started contributing again.

          DH and I do tithe, our attorney said that it's a good idea to include our charitable contributions statements (from the church) for the last two years in our filing package just so it never becomes a question at all from the Trustee. That indicates to me that the law is interpreted that it must be an ongoing event, not something started on the eve of BK.
