    Anyone have the trustee ask for daycare expenses receipts?

    Curious, as i will be using this as a expense in my plan payment.

    Yes, the TT asked me for three months worth of statements.

    My daycare expense was high ( I think ) at about $760 per month so I figured that they would ask.

    I don't know that they can dispute it though as it is a legitimate expense.
    Very fortunate in the grand scheme of things but have learned my lesson.

      The thing with me is that I would be filing as soon as the baby is born, the expense would be for the future, like after 6 weeks of maternity leave, so I wouldnt even have receipts, just a statement from the daycare showing what they actually charge.

        I would include it.

        All they can say is no and you can argue that it is legitimate and will affect your disposable income.

          We used a print out from Kindercare as our baby wasn't due until April & we filed in February. No questions asked--and it was the highest "quote" for childcare we had.

            Well then, that should work for me, but all trustees are different I suppose. Kindercare is ridiculously expensive, I called them about a month ago.

              My neighbor was in the same situation here in AZ. The trustee would not allow her to use statements for "future" expenses. She had to file, wait until the baby was born and in day care for 3 months. She was then able to modify her plan and add the day care expenses. I guess that does make sense that the trustee would not allow her to use "future" expenses in her plan. That would be like adding all future expenses that it takes to raise a child with no proof you are actually paying the money out.

                That is so ridiculous. 3 months is just so overkill, that makes me so p***ed off. Then it looks like I wont be filing until December, I sure hope these creditors are willing to wait that long. Cause if not, I will have to file ASAP and then file a motion to modify the plan. How long ago did your neighbor file her 13?

                We are going to end up getting sued, and then I will just file it as soon as they file a complaint with the court so that I can stop them.
                How am I supposed to pay for the expense of daycare, if the plan is setup without the costs? That means they are taking my disposable income that doesn't have the costs of daycare in it. Where am I supposed to come up the money to actually pay for 3 months to the daycare provider?

                  Just got a update from my attorney, im so glad I hired him, he replies to my emails in like 2 hours.

                  I can file after the baby is born, unless my daycare is some ludicrous amount, would he even ask for receipts, and by the time he would, my attorney said it would be 90 days down the road anyway. So by that time, I would already have them.

                  What a relief.

                  I am looking forward to third party collectors relentlessly calling me and threatening to sue. I will just tell them, well when you go file your complaint, I might see you there cause I will file my petition as soon as you do.

                      My thoughts exactly, because I most likely will be using a private baby sitter. My guess is that you will need to have them sign something that is notarized stating what they charge you specifically, and then show cancelled checks with their name on it. Or just go find the lowest priced daycare, and have them give you the three months statements and tuff it out, then take them out of the daycare and back to the lower priced daycare provider.

                        LOL, DS goes to KinderCare. His is $700 a month, but even though I was PG when I filed I was unable to include future daycare expenses in my plan. They told me I'd have to file an ammendment.
