We've been waiting for the past 6 months to file a 13 (had to wait for a large bonus to fall off the income test). Now it's finally time and we're just about ready to file, but I was just informed yesterday that my pay will be cut by about $600 a month starting next payday. It's a company-wide pay reduction.
So now it looks like I need to start the 6-month clock all over again and wait until I have 6 months of paystubs at the lower pay level to be used for the income test. I don't think we'd be able to afford the 13 payment if it was calculated at my current income level for the past 6 months, before the $600 pay reduction.
Anyway, my issue is that we stopped paying on our CC's back in October last year (4 months now with no payments) because we were planning to file in Feb this year. Now we're looking a possibly another 6 months. I'm not sure if we could go that long without being sued, wage garnishment, etc.
Does anyone have any advice here? Should I go ahead and file and include a copy of the pay reduction letter in hopes that the attorney and trustee will consider the lower pay going forward when calculating my 13 plan payment? Or should I just start the 6 month clock all over again and hope to not be sued in the mean time?
