I will be getting a job as soon as i get back home-been in vegas for 16 months lookin for work. Want to file 13. all debt is in my name, husband refied the house in 7/08 my name is not on the mortgage, it is on the deed. There is no equity and i am not on his investment account, was 30K, now about 17K. I have about 45K in CC debt. Can I do this without hurting him. He has perfect credit, pays the mortgage and has never even owned a CC. Can someone please talk to me??

You cannot file a Chapter 13 without income to fund the Plan. Unless you have an actual job in hand, the best thing for you to do right now is to consult with a BK attorney to find out what you can and cannot do, and in what state since you are now in NV and plan to move back to MI._________________________________________
