My Attorney prepared a plan that I could not afford. He stated that the reasons were to get the Trustee to approve it and get the plan confirm. He said after the confirmation hearing, I can modify my plan for a lower amount. I submitted all my expenses to him prior to the confirmation and he could clearly see I could not afford $955.00 a month. So my motion was heard on 1/16/09 and the Judge denied it because the plan was recently confirmed on 11/21/08. Now I am obligated to pay this amount. I had to take out internet payday loans to cover my expenses....I don't know what to do. I thought the courts were suppose to help me by establishing an affordable plan for the next five years. I think my case will be dismiss...I just can not afford it.
