    Hi all

    I was told my company was downsizing in Oct 07, I sold new home construction in a state for 17 years. I went from 140K a year to 25K a year. I moved to another state thinking I could find a job selling homes, that didnt work out so well. I am now waitress. My husband is still in the other state and my income from serving is now almost nothing. I am going back to husband. He did a refi on our home because I called credit solutions and they told me to stop paying my credit cards a year ago, I had to stay off the mortgage. I am going back and filing chapter 13. I have no money and credit solutions took 8K and did nothing!!! Our home HAD some equity but we would be lucky to break even if sold. All unsecured debt is in my name only (45K). My husband has an investment account with about 30K in it, his name only. I took my half a year ago to move. If I file alone can they go after his accounts? Can we keep the home? I am on the deed. I do not have a job yet and know I need one in order to file. What should I do? I will never make the money I did, I will end up with a $9 an hour job and it will be hard to find. I want to make sure my husband is safe,he has never owned a credit card, he has never had any type of loan other than the mortgage, he has a 780 credit score and I dont want him hurt. Is this possiable?

    I joined Credit Solutions also and lost about $8,000 too. What a waste of time and money. I finally filed 13 and certainly wished I had done this before the debt settlement scam. Sorry I don't know the answer to your question, I just had to vent.

      to file a chapter 13 you must have income. You probably could qualify for a chapter 7 on your own but residency requirements and your husband's income will also be factors. Get a free consult from several BK attorney's in your area.

          I will get a job the minute I get home, can I do chapter 13 after I get the job? Will it affect my husband if he isnt on any of my debt? My name is not on any account and he is the only one on the mortgage. There is no equity in the house anymore.

            We tried Credit Solutions too and of course, they didn't do anything for us either. After the endless collection calls we realized we had to do something, thus filed bankruptcy. However, I got to thinking that since Credit Solutions didn't do anything for us that we should get some of our money refunded! I tried to get all of it of course but couldn't. We paid them a little over $3,000 and did get back $1,300. Just call them and tell them you want to cancel their service and cancel any automatic deductions from your bank account. They'll try to keep your business but I just told them that we decided on another path and wanted a refund of our money. I didn't get an argument about the refund either. They e-mailed me a form, I signed it and the partial refund was deposited into our bank account. That was the end of that. It's worth a try! Good luck to you.
