    Loan from 401K

    We are currently 6 months away from completing our chapter 13. Things have been pretty uneventful until recently and we don't know what else to do. My husbands hours have been cut since July and we've been surviving. Bills are being paid but there's hardly anything left over each month. We just completed our income taxes and found out we are going to owe almost $2000. I have a doctor's appt next week and am fairly certain I will need surgery to repair a hernia soon. I've been putting it off until our bankruptcy is finished, but it's been bothering me so much lately, I don't think it will wait 6 more months. Even though we have insurance, I still have a $500 deductible I have to meet plus we're responsible for a percentage of the bill. Our only way out is to take out a loan against my husband's 401K to pay these things. Anybody have any advice about doing this? If anyone has any other suggestions, I'm listening!

    Before you proceed, contact your Chapter 13 attorney about this. You may need Trustee approval to do so since those funds were exempt in your Chapter 13 filing.

      I don't think you will even need the loan. It also sounds like you have some time on your side. You don't technically have to file your taxes until April 15. By that point, you should only have a couple months left of your 13. I'm sure if you discussed that with the IRS at that time, they would work something out with you to defer payments until you are finished with your 13.

      The same goes for your surgery. I say, have the surgery if you really need it and can't wait. It will probably take a bit to get scheduled. Then work something out afterwards to defer payment until your discharge. Maybe even send them a "good faith" payment here and there if you are able to squeeze it out of your budget.

      It's not like you would be saying you didn't know when you could pay them, just that you might need to defer it for a couple of months.

      This may be more manageable than it seems at this point.
