    I live in Calif, so yes they can garnish my wages. I will file for BK ASAP *if* I get sued, you can't be in fear that the creditors will sue you, if they do, just file sooner . I stopped paying my credit cards in mid May (72k debt). Haven't heard a peep from the creditors (my attorney takes the calls). Get a car before your credit score takes a hit. Good Luck!
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      If you hired an attorney, what exactly does an attorney do if you don't file bankruptcy (or what can they do legally)? How are you being billed?

      I'm amazed you went that long without paying a cent to your cc debt without a judgement or garnishment threat.

        I agree that there is little reason to file until you get sued. In my state they can only garnish 10% of the gross so this puts a cap on what I'd be willing to pay in a chapter 13 plan.

        The more I think about it the more unlikely I think it is that I'll get sued, which I guess means I'd better get used to the phone calls.

          Well, I am filing BK, so that isn't an issue. The issue is, I been trying to save extra $$ to pay the attorney ($3400) and I thought that I would have all this extra $$ when I stopped paying the cc's, but no. I guess I didn't realize how much I relied on credit cards for the little things: gas, eating out, etc. I haven't use a credit card in over 8 months and it feels great, although I've had a few "emergencies" that ended up taking the money I saved for the attorney. My attorney has been really nice about payments, I send him what I can when I can.
