    Timeline of a chapter 13.

    Could someone tell me what is the timeline of a Chapter 13.

    From filing the petition.

    To actual confirmation.

    Lets assume that there are no objections, and it is a fairly straight forward case.

    Our case:
    Filed early April 2002
    341 Hearing - early June 2002
    Confirmation - September 2002
    No objections
    _________________________________________
    Filed 5 Year Chapter 13: April 2002
    Early Buy-Out: April 2006
    Discharge: August 2006

        The timeline varies by District. However, some things are set in stone.

        First meeting of creditors (341 meeting) must be scheduled 60 days after the filing date.

        Last date to file claims (claims bar date) for non-governmental creditors is 90 days from the 341 meeting.

        Confirmation has to be within 60 days of teh filing. This is the tricky part. Most Districts, including mine, only have an initial confirmation hearing within 60 days. This hearing is almost always continued to a later date. Most Districts try to have the confirmation hearing after the claims bar date.

        Other events can cause confirmation to be delayed, but generally, the like to get it done in 5 months.

        None of this affects your starting to pay into your Chapter 13, which will begin 30 days after filing.

          Your plan must be filed with your petition, or within 15 days of filing your petition or your case will be dismissed.

          You can amend your Plan at will prior to confirmation.

          After confirmation, it gets difficult, but not impossible, to change your Plan. You need a good basis (reason) to change your plan post confirmation. A change in financial condition is an excellent reason to have it changed.

          Even to make it more interesting, the Trustee or an unsecured creditor can motion to have your plan amended post confirmation!
