    wishing to vent about GMACM

    OK. So I lost my job making aprx $150K Mar 07, and it took a year to go thru my 401k savings as I kept the mortgage and living and all debts going with hubby making $45K...

    ...I thought I was so smart.

    I was going to sell the $400K house with (what I thought) was $60-70K equity and move, downsize, simplify and make $80K a year in a new state. Live simply, y'know?

    Well, the house didn't sell. Still hasn't - YET - BUT we have a short sale pending as of August for $200K ($125K short of 1st and 2nd with GMACM), I quit making payments in Jan, when I moved to Utah. GMACM approved the short sale on the 1st, I thought that also meant on the 2nd, since SAME LENDER....

    Anyway, short sale pending, and I am NOT making what one would expect in the high-line auto biz - like about 1/2 - and ran out of money to continue paying the CC bills. BK looming. I had no where to turn.

    Filed CH13 in October. Short sale was still pending.

    My loan was transfered to the GMACM BK department.

    They miraculously do not have ANY RECORD OF ANYTHING THAT HAS PREVIOUSLY TRANSPIRED!!!!!!

    WTF????

    Dragging of feet, etc on their part. We named GMACM in the filing.

    THERE IS A SHORT SALE OFFER PENDING....

    Well, after hopping thru hoops and GMACM bk dept AND THEIR ATTY have NONE of the previous communications or data,


    THEY ARE TRANSFERING THE LOAN TO ANOTHER LENDER.

    My God. When will this crap END?????

    I have to start all over with the new lender.

    Just how damaging is a forecloser in light of the fact that I filed CH13?

    Is this worth all my effort?????

    Why couldnt you qualify for a Chapter 7 when your hubby was making $45K a year? That's when I would have filed.....

      Now that you've actually filed, you do not need to do anything!!!

      Just list the home as being surrendered in your Plan, and be done with it.

      Selling a home in a short sale or deed-in-lieu is just an exercise in futility, when you're in Bankruptcy. It does absolutely nothing for you!

      I'm surprised your lawyer hasn't told you this.

      If your Plan is already confirmed and you listed that you were surrendering your home... you just walk! You're done!
