    Citibank dragging their feet

    Filed bk 10/15/05; yup right before rule change. Paid into plan faithfully for 36 months and now at the end of plan ready to dismiss and return to some sort of normalcy.....WRONG. Case is being held open by CitiMortgage because they are dragging their feet on reinstating our mortgage. Has this happened to anyone else?

    First of all, a big CONGRATS for successful completion of your Ch 13 - fantastic! Way to go! Woohooooo!!

    Now to your question....unfortunately mortgage issues after completing a successful Ch 13 are encountered at times. If you haven't already, contact your lawyer to discuss what legal options (if any) you have in this situation. Good luck!

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Thanks, it's been a long road to recovery.

      We have gotten more information and help from the trustee, who is equally frustrated with CitiMortgage, than our attorney. I shudder at the possibility of having to pay out more money to get this case closed. We have a substantial reserve in our trustee account to cover the costs, but would be nice to get that money back.

      We've yet to contact our lawyer and judging from CitiBank's financial issues this probably isn't high on their to-do list. It looks like this is what we will have to do.

          Received a call from our trustee that CitiShank wants close to $1800 in fees to reinstate the loan. The bulk of there request was for late fees for the time we were under the 13 plan.

          The trustee raised the B.S. flag and is pushing back against CitiStank illegal fees.

            There are protections in the Bankruptcy Code specifically for this.

            These mortgage servicers will take the money during a Chapter 13, but put it into suspense accounts, and continually bill late fees.

            Then, at the end of the Chapter 13, summarily get a judgment for foreclosure.

            Good for the Trustee and you and your lawyer need to hit Citibank where it hurts.

            This should also be a stay violation as well, if you ask me.

              Yes, this happened to us and we had to fight with them day and nite just to get our mortgage out of the BK and back into Citimortgage regular account! It was a nightmare!!!

                Our case was supposed to have been closed in Oct, now we are looking at sometime in Jan or Feb depending upon what Citibank come back with to the Trustee.
