    341 Today, nervous

    Hi everyone...well today is the day for our 341. I'll be soo glad when it's over. I'm praying that the plan isn't changed. We're keeping our car and it's in the plan...our attny has reduced the interest and it will actually be paid off a year earlier. So, wish me luck! I'll post when it's over.

    Thanks everyone for your support....this forum is a lifesaver!

        Hi Guys, we're back and survived. I was soo nervous and so was hubby. We were scheduled for !:20 along with several others. The clerk went to lunch and came back after 1:30. We stood in the hall waiting for the room to be unlocked with our attorney. When he finally came, we were called first. We were sworn in. In KY there is a bk clerk and he does the swearing in. Then our attny read from a list of ?? the usual...have you filed bk before...have you given away property...do you see any change in your financial situation...have you read the petition...etc...once it got started probably 10-15 min...then the clerk says...any creditors present...no...well looks like the only secured debt is the vehicle...looks like no objections...that's all.

        Beforehand the attny said that ch 13 plans usually need to be tweaked and that we'd talk about that later...well, during the process the clerk said there were no objections so that was all he had. Does this mean it's over once we get confirmed??

        The attny said we don't need to go to the confirmation...that he had other court appearances, but we didn't need to show up. Is it done? Is the plan pretty much done???

        WOHOO!! Our attny was actually the one who read the ?? which made it easier. I have to say I was so nervous...it took us quite a while after to calm down. We just drove around for awhile...

            Congrats on everything going smoothly! I hope the same for us when its our time! I am already nervous and worried just thinking about it!

              Your basically right - the big stuff is over. Congratulations!

              However, prepare yourself for an objection or two to pop-up before your plan is confirmed. I read that most 13's have some objections from the trustee and they're usually all minor (missing form, information, blah blah blah) and your attorney will usually just take care of it. They'll usually receive the same piece of mail you get the same-day you receive it.

              And FYI - it's my understanding that even though creditors didn't appear - they can still file an objection. But again, that will be taken care of by your attorney. And a creditor filing an objection is less-likely than the trustee filing one. But again - usually all minor stuff. So don't worry.

              If your attorney said you didn't need to attend your confirmation hearing - then you don't.

              Your attorney will let you know if anything major pop's up.

              And since most correspondence from the trustee you receive in the mail arrives on Friday - that can make for a long, worried weekend. Don't worry about it, if there were major problems - you would have already been made aware.

                Thanks busby and everyone for your support I am glad it's over...although there was no need to be so nervous...I guess it's just part of it all!
