    So I talked to a BK atty in FL about case

    I have 45K in CC and 14K auto

    He said to stop paying though I have been doing balance xfers (most 3+ months) the recent was 11/24 off line of credit through credit union). he said to stop paying all even the CU that I hacent paid $0 to...) I have a truck I want to give back due to $3K neg equity. I have my name on my moms savings which he told me to spend half of ( 16K spend $8K) going to pay to go to cosmetology school.

    I want to talk to another BK atty. Have 2 scheduled this week. I have $4500 on savings and not $14K on moms joing. Was thinking on spending $12K on cosmetology school next month.

    He said my $45K in CC debt he could shrink to $100-$150 payment for 36 months but reading here I'm not sure I can beleive it. However I am living in Florida since September 08 and previously resided in Marlyand. I have been on unemployment of $352 a week for 6 months, I have another 02 weeks to go at same amount and after that will get a part time job making about the same. Is he right with his calculations?

    Any insight would be appreciated!

    I have y name on my moms savings of 14K. I want ot go to cosmetology school and was going to use this because the atty said i needed to use it. Is that correct? How much can you have on your savings? I have 4500 in mine but this atty fees is 3500. He said I have to pay it out of my acct... I saw some people say it was rolled in. How much are you exempt? I dont know what my exempotiond are because i have only lived in Florida for 3 months and prior I lived in Marlyand.

    Welcome to the forum, and my very best wishes go to you. You are wise to talk to more than one attorney.

    First thing, you need to invest in Nolopress.com's books on Bankruptcy. They have an excellent plain English guide to CH7. You can purchase online and download it to your computer. They also have a CH13 book. Since I don't know--and you probably don't either--which chapter you will ultimately end up filing, if you do end up filing, I suggest purchasing the CH7 book as it is about half price of the CH13 book.

    Reading this will give you a good start at educating yourself as to the do's and don'ts of BK. The more you learn, the more you will be able to discern whether your eventual attorney is actually telling you the truth or not.

    I just checked Nolo's site, and I see the CH7 book has been newly revised as of October 2008, so that will contain the latest information.

    Nolo also gives a 'freebie' with their online purchases; take that too, as it is a layman's guide to simple legal matters such as wills, etc.

    PS: Since you are considering BK, I would get your name off your mother's account, and get your money seperated from your mother's. You will need to let at least 90 days pass--better to be 180 days--before you file. There is a 6 month look-back period.

      Why are you posting on the ch 13 board? What benefit do you think you will get from filing a 13 rather than a 7?

        follow up

        Well I am posting on the C13 because the atty said thats what I needed to file because of the assets I have my name on and that he was worried about my belongings and the trustee because I am renting and everything in my house belongs to my mom except my computer camera and tv. I have two more appointments this week with other attys.

        I will look into those books. Thanks.
