I'm behind approx 4 months on both my first and second mortgages - when I file, does the back mortgage payments get put in 'the plan' or is it handled separately ? - Thanks

The past due payments (along with attorney fees and any pre-foreclosure fees) will be lumped into something called "arrearages". You have to pay back the arrearages over the term of your Chapter 13 Plan. That could be 36 to 60 months.
While you're paying back your arrearages, you also pay back your secured creditors and may need to pay back unsecured creditors, based on yoru disposable monthly income.Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
