    Are you kidding me...geez

    Ok so as u guys know I am filing 13--(filing on tuesday) So I have been letting creditors know giving them attorney info etc. So Zales calls me when I am about 10 days late and I tell them whats up. 2 days ago I get a call from Northland Collections saying they are handling the debt blah blah...is this normal? Zales obviously sold the debt because when I called Zales to find out what was going on they said there is no acct for me there. So I told Northland I was filing and of course they were nasty but I could care less. Do you think I should go ahead and add Northland to my matrix so they can get the mssage? I dont have an acct number for them --the guy was super secret and wouldnt give me any acct info unless I was making an arrangement to pay---but if I use my SSN do you think it would suffice????

    This is crazy I am only about 15 days late on any of my bills they arent wasting any time....most are still current.

    Yes, you add anyone who ever had their hands on your debt.

    Zales does tend to be more aggressive. Unlike consumer electronics and other consumer goods, Jewelry does have a viable recovery value; so you can expect them to be somewhat of a hassle in your BK, but in the big picture, nothing serious.

      HHM--I have nothing to give them lol most of the stuff purchased was for xmas so I dont have anything. I was suprised by their actions because myself and my hubby both have zales cards (individual accts) and his hasn't been sent off...but now that I think about it they havent even called for him and he is actually later by about 6 days than me....no rhyme or reason I guess for the things they do. When Northland called he said, "you should have gotten a letter in the mail from us" I was like like no--wtf r u talking about. Anyway he said I owe them 3717 (the exact amount owed to Zales) I told him about BK he said sorry---and havent heard from them since. I dont have an acct number but if I simply put their name in the matrix will that be sufficient without an acct number?

        Yes. You provide the attorney the Zales account info including the account number and then show that the CA is also collecting. The attorney puts them both in the matrix for you

          Here's a good pointer for folks. When you list debts on your schedules, make sure you indicate that it may be a duplicate for another debt! If you were to list Zales and the CA, you'd have two listings for the same debt.

          I only say this because I had about $40K in duplicate debt on my schedules due to CAs. I'm very near the 109(e) debt limits for a Chapter 13 ($336,900 for unsecured creditors). I'm actually within $1K given what claims are filed.

          It can also make a difference if your actually DISPUTE the amount of validity of the debt. Also make sure your lawyer checks the "disputed" column on your schedule F if you don't agree with the balance or who owns it.

            My attorney listed both, but for the CA he put "Representing OC name" and did not duplicate the amount of the claim. That way both the OC was listed with the claim amount AND the CA was listed that was collecting for the OC, but no claim amount so the amount of claims was not inflated.

              You have an attorney who knows what s/he is doing. I've read other cases, where the lawyer just blindly entered everything from the credit report into Best Case.

              The lawyer... well... the Debtor had to argue later that the claims were disputed and/or duplicates! (This was a Middle District of Florida case where B-Line was aggressively trying to get their claims allowed.)

                Greetings! We are meeting with attorney next week to discuss our options; probably won't be able to do Ch 7, so my question on Ch 13 in re: to above post is: based on folks' experience, which creditors tend to be more aggressive about filing? Our biggest concern is an unsecured loan with HSBC for $20,000.

                  Yes definitely list any CA that appear before you file. I had a similar issue and told my attorney if the attorney kept dragging their feet in filing my paper work I would continue insist they update my matrix up to the actual day the efile my paperwork (btw it was yesterday). I had to tell my attorney that my cards are now starting to be sent to collections and I wanted to file before everything ends up in collections.

                    Another addition here looks like Zales also sent hubby's acct to a different agency but thank goodness I checked the mail before we went to the lawyer to file lol---so we addd them too. Lawyer listed both as duplicate so both cant collect.
