go on a trip already paid for? HELP

    All,

we have a cruise that was paid back in sept. It looks like we're heading for bankruptcy, but if I dont go I cant get any money back. Should I go on the trip sort of as a last hurrah, or is it better to bail on this now? I believe that the trip will cost us about 1200 this month, but I don't want to cause issues during the ch13 proceedings. My gut tells me not to go, but how far back do they look at the credit card transactions?

I'm hoping the trip can save my marriage, from all the stress this has caused, but I don't want to screw us for the next 5yrs.

    HELP!

If the trip is already paid for and not refundable, then I think you could go but only if you can pay CASH on this trip for the bar tab and the tips and the extra's. I would NOT charge 1 penny of this trip on ANY card, including the clothing to go. If you can't do it without charging, then you can't afford to go. If you can't come up with the cash without missing out on other payments, then you can't afford to go. You will have to decide. As to saving your marriage, if your partner is not buying in to the strict budget you will be on for the next five years, then your marriage won't be saved by 1 cruise.

what about the fact that it was paid for in aug/sept on a cc. Am I screwed already?

If you have made payments on that card since, then no you are not screwed. No one plans to file BK, inmo. It is a realization that happens when there is no other alternatives. Even then, people will see every other way but to file. In a chapter 13, because the creditors get paid, there is less chance for objection to the charge but AMEX has been known to come after people for using their card and then filing. But Sept to January, you should be ok.

If it's already paid for with your credit card just dispute the charge and get a chargeback credit on the card. Once the cruise line realizes it they will cancel your reservation. When is this cruise supposed to begin?

I say go for it!!! It's already paid for and you guys need this vacation, just don't charge anything on the trip. *If* the cc challenges the cruise charge, you'll just have to pay back the $1200...

                  Have fun!

That's really pushing it if you are commenting on my previous post. But it still might work. The cruise line however might/will hound you for late cancellation fees.

So if I pay it on the card and then pay that amount off of the card I should be in the clear? Paying that off would mean I'd be late on something else though. What about pushing off the filing for a few months and just fall behind on the CCs knowing that we're going into ch13?

why are you still paying CCs if you are planning to file anyway?

No, No, No! Don't use the cc for anything more! Just use cash for everything on the cruise and push back the filing date if you can. Don't pay anymore to the cc, it's a waste of your $$ at this point since you know you are filing for bk.

                            Good Luck!

If you can't afford to pay cash from here on out, then you CAN NOT afford this trip. NO MORE CREDIT. It is what got you here in the first place. Time to rest the plastic for a few years. plus if you charge over 600 and then pay it off, the trustee can get that money back from the creditor as preferential. PAY CASH or stay home! those are your choices
