    The Court will not advise you on this because it would be considered legal advice.

        No, you cannot proceed in pro per if you are represented by a lawyer. You'd have to fire your lawyer first, and then Motion the court to proceed in pro per and then...

        Doesn't your lawyer have a paralegal assistant? Is this a one man office? You could always go stand in his office and wait for him.

          No it's not a one man show but it might as well be. The have three people working in there and the day I went down there to show them that letter the paralegal SAID yes we got a copy in the mail. He told her to file the needed paper work. Ok I called back to see if they had done so, her reply was I dont have anything on it...its a lost cause every time So I faxed 5 copies and emailed them a copy. I have an appointment Monday to see him which is a half day venture your never seen until an hour after the appoint ment and the people in the office are always playing games on the computer.

          Im tired of this, im going to lose this chance to get it to a fixed rate because of lazyness. They have had over a month to do this and I only have 20 days to secure it now, minus how ever many days the court is closed for Christmas. Personally I think they know if the agreement goes thru then my bankruptcy will be over becuase that is all of the secured debt besides a 300.00 title loan.

          I have had more stress the past 6 months dealing with them than I have with my ex-wife and not getting child support! Which the court still considers income even though im not getting a dime....Sorry to vent.

            Update!!!

            Haven't been on in a while, went to court and the Judge agreed that it would a great thing for the lender to do this. He ok'ed the loan motification and after what seemed like an enternity my mortgage company finally adjusted the rate and rolled the arrears back into the mortgage so I have a fixed rate and all my payments have been on time for a year now.

            It helped not having the ex wife around digging in the checking account.
