    Mortgage Payments

    We filed Ch13 on Oct 2. We are paying both mortgages outside the plan. They both come out automatically out of our checking account every other Friday. I just got a letter today from the first that says they have suspended the auto pay and I have to make other arrangements to make a payment. Is this normal and will our payment go up or something? Or does it stay the same?
    Will I still be able to set it up to come automatically out again?
    I tried to call them but of course they are closed till Monday.

    They are not allowed to "bill" you, so the automatic payment may be causing issues for them. This has to do with the Automatic Stay.

    I don't know specifically what you can do, but other folks have had problems whereby even their "on-line" access to their account was disabled.

      Shutting off your online access or auto pay is pretty much the norm. Countrywide cut off our internet pay so I just call them with a pay by phone, for free, every month.

        We are keeping 2 mortgages. One is my primary residence and the other is a small home we bought for my mother-in-law because she couldn't qualify. She makes the payments each month. We only bought it so she wouldn't live with us. LOL....One mortgage company still allows me to make my payments online with no problem. But CitiMortgage locked me out right away. I did call them and they told me that I can call each month and make my payment and when I am discharged my online access will be reinstated.

        Took 115 days after 341 - But Finally DISCHARGED 3/25/09

          We paid our mortgage and 2nd mortgage also out of our Plan. When your mortgage company is notified that you filed BK and that you will be making payments out of the Plan, your account is transferred to their bankruptcy section and you may be required to send a payment to an entirely new different address. We were for our first mortgage but not for our second as it was through our credit union. Contact your mortgage companies and find out where your new payments are to be sent since you now fall under their bankruptcy section. Keep those payments on time during your Plan and do not be late. It all works for you in the end.

            Thanks for the replies!
            I was hoping to keep the auto pay then I know for sure it is always paid on time and I never worry about it. I'll have to see what they say on Monday.
            I was just worried our payment was going up or something!!

              You may not be able to do that as ours had to be mailed in due to the BK. But check with them and see what they have to say.

                Call and ask them. We were able to keep our autopay on our second mortgage, but they would no longer send us monthly statements. Instead they continue to deduct the amount, but now their BK unit sends us a monthly typed letter indicating the payment was made. We were able to get our first mortgage to send us annual coupon books (we weren't doing autopay on that one) while we've been in BK, though I had to call and remind them to send us a new one this year when it was time.
