    What is going to happen (end of 13)?

    Hi all -

    I've been a good do-be and I guess - in theory- my BK is over. Filed 9/21/05(old law). 3 year plan. Made all my payments. Did everything I was supposed to. 3 years = 9/21/08

    Have NO clue what's going to happen now or how I will know? My worthless atty of course has not been in touch or sent a response to any of my letters as to what the process is and what I can expect.

    If anyone can give me a quick run down, I'd be grateful!

    Specifically -

    (a) Will my employer get an order telling them to stop taking BK payment out of my checks? And will that happen sooner rather than later? (Paycheck coming up 9/30, for instance, will that have $$ taken out for BK?)

    (b) I know everyone says it takes a while for the discharge papers to come. Will I get anything though saying "case is paid and over"?

    (c) Until the discharge comes though, I am still "in BK" correct? At least for purposes of something like buying a car (nursing my 20 yo car along and hoping it will last until the discharge comes). I also am having issues with IRS (who has been paid 100% through BK but insists I still owe them another $3,000) and so would like to know when they as a creditor, get the info that BK is over and then I can deal with them directly.

    Thanks - hope these aren't too basic (stupid) questions!

    It's been a LONG HARD road, no doubt about it - but if I can do it, I know all you other 13ers can do it too!

      If you do a search on here, you will find some postings by me as to what you are looking for and also by others. I am on here just a few minutes and will be leaving work shortly. Hopefully I will have a chance to log on tonight and can further help you.

          Hi Flamingo - I did see some of what you had said previously. Guess I am pretty much waiting to hear from trustee saying "we got the last payment and here's what happens to get you discharged."

          It surprises me how many people on here have such p*ss poor attorneys, though!

              I'm beginning to believe that the attorneys collect that $1K/year "monitoring fee" and don't really monitor. It's like a "super retainer". Only, they can't call it a retainer.

                I'm going to start from your comment in your first paragraph. You should receive a letter from your Trustee stating he received your last payment and that letter will tell you exactly what is going to occur over the next several weeks. Your Trustee will send out any and all final payments to the creditors and will contact all creditors with documentation that they need to sign and send back stating they have been paid in full according to the Plan. Your Trustee will also audit your Plan and when all that is done, you will receive your Discharge. Our timeline - paid off our Plan mid-April 2006; letter received from Trustee early part of June. Discharged dated August 30, 2006. If you have a wage order, contact your attorney to find out what needs to be done to have that stopped because that is instituted by the Trustee and they have to contact your employer. You yourself cannot stop it. You may want to have someone in your payroll dept. keep you apprised of getting notification from your trustee to stop it. If you overpay, you will be refunded by your Trustee (all part of the audit). Make sure when you make your last payment that you notify your attorney also that you have done so.

                Not everyone has p*** poor attorneys. Ours was fabulous and the key is to shop around and educate yourself prior to the filing process.
