    When filing a BK13, how many months of bank statements and paycheck stubs does the Trustee request see on average?

    Mine asked for only 90 days of pay stubs. Didn't care about my bank account. I'm paying back 80% (so far) to unsecured creditors, and I was so thorough with my forms and schedules, I'm pretty sure they know I'm not hiding anything.

    So, the answer... it depends.

    It depends on the Trustee, your particular case, whether you have passed the means test (using Schedule J for forward-looking expenses), and other things that are probably Trustee specific... e.g. other red flags.

      It all depends...it is usually six months; however, we were asked to provide one year and there have been situations where they go back even further.

        We gave 6 month of both to the attorney, but when he told us we had to go 13, the Trustee only wanted 2 months of pay stubbs and no bank statements.

          I just was at my consult and I need to have my most recent 3 months for the lawyer when I drop off my completed forms/pay the retainer and at the 341 meeting I was told I would need to bring in the 3 most recent received before the meeting.
