    What if you OWE taxes?

    What happens during a Chapter 13 plan if you end up owing on your taxes? When you file do they work out to make sure you break fairly even on deductions? I know I will owe this upcoming year, but its kind of to late to do anything about it at this point!

    Unfortunately, after you file Chapter 13, bills (and taxes) incurred and owing after that time are your responsibility. If you owe taxes for 2008 and the amount is large, if you do not have the funds to pay them you can request a payment plan through the IRS. You will need to ensure you adjust your withholding to you don't end up owing each year.

      I'm not sure how much I will owe with my house interest and dependents. Is there a calculator somewhere to figure this out?

        Talk to your attorney, you can put the 08 taxes into your plan if you haven't filed yet! We had to include an estimate when we filed in 07, then once it's an official amount, the IRS amends it's claim.

          Something very similar to this happened to us. In '07, we were due a refund of $700+ from the IRS. But, we owed $300+ to the State of Arizona. Upon advice from our "all knowing and all wise idiot attorney", we deducted the amount owed to the State from the IRS return, paid the State and sent the Trustee the remainder. Wow!!!! Did that ever get the Trustees panties in a wad. And our dufus lawyer said "Huh, I never heard of that happening". Long story short, we had to borrow from the family, the money to pay the Trustee. I'm learning real quick not to trust anyone who takes your money and claims they know what they're doing. ESPECIALLY DOCTORS WHO CRIPPLE YOU AND STILL GET PAID FOR DOING IT!!!!!!!!!!!
