    question about 13 payment

    well i met with attorney, filled in and signed all the paperwork for a 13. I qualified for a 7, but do to time frame with debts and house issues it was decided to go with 13. After going over the forms i was in the negative for payback. we adjusted amounts to household bills and such until I had 250 in disposable income. I have a stayathome wife and 3 kids. we only have one car and I want to keep it out of plan.

    I got a letter from trustee with his address to mail my $$$ to. Does this mean so far he has accepted the 250? Will it change? I got about 50k in debt give/take most is unsecured.

    second question. Attorney filed paperwork on the 31 of last month and on the 28, a week after i signed papers i got a SURPLUS check of 1k from morgage escrow. Do i get to keep this?

    Be careful with the escrow surplus check. I got one of those last year but I realized the escrow company did not pay my homeowners insurance and so I had to put the money back into my escrow account.

      i checked all of it and got statements. it was all paid. still have check though.. dont know if i will have to give it to trustee, but kids need school clothes.

      any idea if the time i got it and time filed or signed makes a difference if i have to claim it or not?

        The surplus check came in after your filed - notify your attorney. Make sure you advise your attorney your kids need school clothing and items and that you could sure use those funds for school expenses. Secondly, that is one heck of a surplus; what got overpaid? Are you certain that all checks out?

        Your first Chapter 13 payment is due 30 days after you file. That will be before your hearing. Make sure you send it in on time and keep paying that amount when due unless advised otherwise.

          they overestimated my taxes. so out it goes. I got informed of the check after i signed, but they did not have it filed until the next day. They put it into my credit union account i have frozen now because of this 13. So i asked to reverse and they did it then sent the check out. So account shows the deposit and withdrawl.
