Hi everyone. Well as some of you know it's been an up hill battle since Jan of this year. One stumbling block after another. But today was wonderful. Today was my confirmation hearing. All is confirmed. $331 a month. Now here's the kicker.
Last month my atty filed 2 objections to creditor claims.
(1) Asset Acceptance - they filed a claim on a debt that I had over 10 years ago, 1998, which of course the SOL has expired, amount $1200
(2) Wells Fargo - car repo'd back in Sep 07. I was not notified of the date the vehicle was to be sold, they sold it, and stated I had a balance due of $27000.00. We were filing the objection based on Florida law, and the fact that the creditor had already filed a loss and taken it off their taxes.
Well, there are angels looking out for me. Neither of these creditors showed for the hearing. The trustee disallowed their claims!!!!
So I'm free and clear of these claims. $28,200. A large burden off my shoulders and my pocket book.
I was not told how long my plan will be, that's still got to be figured out now since the objections, and my atty has to file the papers. He said it may only be 3 years instead of 5. The amount over 3 years is $11, 916 and 5 years is $19,860.
I make $65,000 a year, live in Florida. I'm paying my car and one more secured outside of the plan. I'm feeling pretty good! So happy! There is finally a light at the end of the tunnel.
Just wanted to share my happiness with everyone.
So for all of you who are feeling down and hopeless, don't......I was stressed to the hill, worried constantly, and it all worked out. Good luck to everyone! And most of all, thanks to everyone here that was my voice of reason and support.
