    Maybe she was hoping to catch your 'other personality'...you know, the one that likes to pay although you are filing bk......

    Yes, Chase was pretty aggressive with the calls, I would give my attorney's info over and over....hang in there

      Hello bcvw, I was wondering what your projected ch 13 payment is. Your financial situation, debt and income is similiar to mine. I know when I meet with my atty I will have this info, but that will be some time from now. Just wanted to get a ballpark of what my payment might be.

        No idea what the payment will be at this point. Worse case I figure around $1900/month (100% to unsecured, car paid outside the plan).

        The payment amount anticipation is the worst part of waiting. Since we are not filing until 10/1, our attorney hasn't started our paperwork yet.

          Sears made contact and offered to negotiate a settlement to avoid being included in the BK. I declined.

            I agree, waiting to hear the payment amount WAS the most difficult part of the process - the anxiety of waiting for that dollar amount was agony...

              Capital One called on Sunday and asked for my wife. She wasn't home but I told them I could speak for her and began to tell the person of the filing. She stopped me short and said she could only take the info from my wife.

                Checked my credit score today... It dropped 100 points in the past week.

                  I got a call from citi the other day, it was like 8:15A.M. so I see the called and figured if i do not answer it they will call back in 20 minutes.

                  So I answer, she says can i speak to so and so

                  I say speaking and she says you are 30 days past due

                  I tell her that someone has called 2 times and that i have given them the attorney info. and that they should be callig there office.

                  She says We don't have to call anyoe but you, so i said well i am filing a BK7 and you have to call the attorney.

                  She says I will continue to call you everyday. SO I said GREAT!!! then i guess i won't need to set my alarm to get up in the morning. I would like a wake call everyday at 8:15 a.m. My hubby was histerical.

                  Then she huffed and hung up and hasn't called back since. Needless, to say I have to still continue to set my alarm... The nerve........... LOL

                  Sometimes you just need to laugh otherwise, they will drive you crazy.

                    bcvw, I'd expect another 100 point drop once the BK 13 hits - that was my experience. I had a 100% on time pay history too, but like you saw the handwriting on the wall and knew something had to be done. There's a big score hit when the first lates show up, then another when the 13 comes in.

                    Even after telling them attorney names etc the Original Creditors still have the right to call. Bill collectors can't but I didn't have any collection accounts so that didn't help me.

                    With the callers, I found that many of them were using Power Dialers and didn't even have the account info until I picked up the phone. Usually if I asked them to look at the prior call records they 'Found' where someone had already taken the BK information. I tried to be nice, but didn't put up with them trying to get me to make payments after I informed them of BK. Only once did I have to tell the guy he was asking me to make an illegal preferential payment, mostly the callers were nice about everything, I just got tired of reciting the script.

                    I had my 341 hearing today, yet one of the Credit Unions (Visa acct) called when I got home. They'd been served TWICE and still don't have it right. My car note is with them so I'm not going to make a stink.

                      Dear bvvw, welcome to the forum. Your story and mine are very similar. My wife and I were making around 120k per year when we filed. My wife handled all the bills and i can`t blame her for it, but I hadn`t realized how far in debt we had gotten until we tried to purchase a new vehicle and were having trouble getting a loan due to a 600 credit score. We had never been late on any cc`s or our mortgage. when i sat down and looked at our situation and saw that we had 120k in unsecured cc debt. I knew we had been making all the minimum payments and could probably continue doing so for some time, but short of inheriting a large amount of money or hitting the lottery there was no way we would ever climb out of the debt. We filed 20 months ago and although it has thoroughly sucked, i realize it`s the only way to the light at the end of the tunnel. Unlike you, i didn`t find this forum until after I had filed and had my monthly payments set. 75% payback 1600 a month for 60 months. There were a lot of questions I could have asked our lawyer but didn`t know about at the time. I think I could have worked out a lot better deal. My advise to you is to use this forum, myself included so you know what to ask your attorney before you go to court. Once you`ve done that and you attorney gets paid back, If they are like most, they don`t seem to have much time for you anymore. Keep in touch my friend and ask away. Take your time. Once all your creditors have been told you are filing ch13 and have been givn a case # they will leave you alone.work the best deal out for yourself as 60 months is a long time!!!!!                         If it makes you feel any better your score is still higher than mine. LOL.. even after dropping 100 points.
