    child support

The trustee wanted the name and address of the person my husband pays child support to. We pay through the court in another state. I called to give the secretary that info and she told me they needed her actual name and address. They are going to send her a letter notifying her. This is so humiliating. Why can't they just go through the court for verification we are paying what we say we do and that we don't owe back support? This woman will get such a kick out of this. Are they delibertly trying to embarrass us so we learn our lesson or what? I just want to cry. This is hard enough to swallow without her knowing. She will tell everyone she knows too.

It stinks, but it is what it is.

Hold your heads up high knowing that at least with all the money problems, you are holding up your obligation to the children.

Many people would be complaining about paying the child support. You are not.

Thank you for saying that. It does stink. And I am sure she will try her best to make trouble. She always does. I have already told my husband to contact the courts for a certified copy of the records showing what we are ordered to pay and that we are current. Just in case she should try to trump up something.

I am sure that they are going to list her as well just in case she comes in and tries you claim you owe her more money. Think of it as cya instead of an embarrassment.

I agree with r'gramma: that child support is a debt. Getting certified copies from the court is a very good idea.

          Good luck!

            Good point Gramma.

BTW, child support is not a debt. Child support arrears is a debt.

What is going on here is that the Trustee wants proof child support is being paid and being paid to an actual person. That's all it is about.

I'm a little late to the party here... but we're in the same situation. My husband's ex-wife is the most uncivilized person on earth and when we found out we had to give our attorney her name and address we were just mortified. Our attorney said she is considered a "creditor" since we owe her money. My husband is not behind on child support, but since he pays it to her every month she will be listed as a "Priority Creditor" in our bankruptcy and will receive an invitation to our 341 meeting. The woman called us a week after we filed and gave us hell about it. "Oh, so you're filing bankruptcy? I always knew you were a loser." We tried explaining to her we were paying all of our creditors back but apparently she isn't aware of how ch. 13 works because she just kept on "Duh, bankruptcy is when you DONT pay your creditors back, scum bags!" Ahhhh.... this is what we have to deal with all the time. It's just paradise...
