    Amex really does suck!

    I don't know if you guys remember but I settled with Amex for $5K and they STILL want the plan payments on top of that.....
    It's either that or go to court. I don't want to deal with that so I have to pay. It's not that I shoudn't pay but wow, they pay hardball...so I'll end up paying them like a secured debt.
    Warning to all..
    If you do ANY type of cash advance or charge, make sure there is at LEAST 4-6 months in between your last purchase and your filing, especially if it's AMEX.

      Do you have to pay them because you didn't wait 4-6 months after a cash advance before you filed? I was late 4 days and they sent me an email that any charge that come through will be denied! This is the first month I have missed.

        Why are you having to pay them twice? If they are in the plan, then they should either take plan amount or whatever you settled on. I wouldn't pay them twice.

          majormike, if you dont mind me asking. how much were you over the mean test or how much are you making a month or how much disposable income you have left that you end up paying 825/month?

            If he is paying $825/mo, it's because that figure IS his disposable income per month..........Not trying to be a smartie, but that's how plan payments are determined.

            Everyone's case is different. Trying to compare your plan to anyone else's is like comparing apples to oranges............

              I had an American Express card and when I filed bankruptcy, they promptly sent me a letter, informing me that my account had been "cancelled"....Gee, ya think?

              As for the John McCain ad...um...why not? That's who I'm voting for!

                  Yes, AMEX does totally suck! Discover gets my vote as the most reasonable creditor to work with.

                    Yes, they want the plan payments AND the settlement or they want to take me to court. Those are my options. I charged within 90 days for part of it and 120 days for the rest. They will get almost all their money back ( the balance ), which is fine. I owe it, I guess.
                    Won't turn this into a political argument but I'm allowed to say that the administration that is in there really messed up for all of us as it's been stated in other posts previous to me by the mods...and I'm not going through that crap again for another 4 years!!!

                      Because plan payments are only 5% and I owe them $7K so if they just took the plan payments they would only get $350. Now they will get $5350.00

                          Look at the bright side...

                          Sorry to hear that MM, but look at the bright side. At least you have the extra money to pay it. You had mentioned in earlier posts when this whole thing came up with Amex, that you had the $ and wanted to pay them off before the BK was finished. I'm just glad that you are able to do this. You'll feel better with all of this behind you. Imagine not being able to pay and Amex squeezing you for their money...dragging this out forever.

                            They won't LET me pay it off now. They are making me wait until the end of BK and start paying $200/mo until it's paid off.....I wish I could start paying now, trust me!

                              Who says you can't "Pay now"........just don't pay "them".

                              Stick it in a savings, and after discharge, you can pay it off in a lump sum.

                              then you really do have a fresh start once you're discharged
