    Switching lawyers before 341

    Has anyone switched lawyers before the 341?

    The reason why I ask is that the lawyer submitted my paperwork with my incomplete name. This affected my Dad, and we have similiar names.

    My dad had sent mail to the CRA noting that the bankruptcy on his credit report was inaccurate.

    My lawyer has since updated the filing documents, and I see it in PACER.

    Frankly unless this lawyer has proven himself incompetent by making multiple mistakes that hurt your case, innocent mistakes can and do happen. There's a LOT to keep straight, especially in a Ch 13 filing.

    Was your name incomplete on your Ch 13 forms when you signed them?

    Jumping ship on a Ch 13 after filing is not a good idea unless you have no choice. Better be certain this is what you want to do before you fire your lawyer because many Ch 13 lawyers are very reluctant to take on a case filed by someone else, even if there aren't significant mistakes, and often will charge more in that situation.

      All of the documents that I submitted to the lawyer had my complete name on it. The documents he created left out my first name.

      I was just fustrated on how long it took to amended the submitted paperwork. It took him 4 to 5 business days to correct the name.

      I probably was over reacting to it when the issue showed up on my father's credit report.
