    Converting to Chap 7

    We have been in a bankruptcy now for 2 1/2 years on a 5 year plan. Things are too hectic and we are sick of living off the poverty level so we have converted to a chap 7. My lawyer filed this last week and already the national data center has the chap 13 listed as converted after confirmation. and a close date of 12 june 08. My question is this. When do I start getting paid like a real person again? They have taken out weekly deductions since this started. Can I call the trustees office and ask? My lawyer says it will be about 3 weeks. Any input? thanks

    This type of timeline is often very local court-dependent. Your lawyer's "about 3 weeks" estimate carries a lot more weight than any guesses from us here

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      What is the approx. cost of the conversation? I'm sure it will vary from State to State. Thanks.

        If you receive a discharge under Chapter 7 it will have an effective date. The Chapter 13 trustee will be required to return any money in your account after that date - including any money that might have been disbursed prior to advice (that's highly unlikely).

          For the Court, it doesn't vary. It's the difference in the $299 Chapter 7 filing fee and the $274 Chapter 13 filing fee. So that's $25.00.

          Of course, your lawyer may or may not add to these fees.

            Get the Dismissal of Ch 13 court order from your lawyer and fax it to your place of employment. You can call them to get the # to the garnishment dept also. Then talk to them and fax them the order. That's what I did and soon as they got it, they stopped taking out the $$ from my paycheck. Anything the trustee got prior to the dismissal was paid out, but anything they got after the date of dismissal was sent back to me in a check not long after that.
