    lawyer filing issues

    I am having an issue with my lawyer and the chapter 13 filing. He had submitted the paperwork, but he did not put my full name.

    I have contacted him to update the filing, but as of yet, I have not seen any changes in pacer.

    I am not sure but if your name is wrong as our is often misspelled, due to the fact the common spelling has one "N" on the end but we use two "N's" we are AKA in anycase. As long as your S.S. number is correct, it is you. My wife does not use my last name. Never has. When filing our Income tax does not. Yet we are married. When signing legal papers she uses a hyphonated her last hyphen my last. I don't think it matters, if it is you, it IS you, by the SS number. 'Hub

      That can be a problem if not corrected by the time of your 341 meeting. You have to provide proof of ID that is your exact name. We had to have our Driver's Licenses and our S.S. cards with us. Because I don’t use my husband’s last name, we had to have our marriage license also proving that we are married.

      We also have a problem in that his last name is commonly misspelled with one ‘n’ when in fact it is spelled with two ‘n’s. That is an AKA situation that should not be a problem if that is what your situation is.

        The reason I brought this up was that my dad and I have similar names, i.e. dad and dad, Jr. Also, the lawyer did not put my complete name on the filing.

        My filing appeared on dad's credit report. He has already disputed it on his credit reports, but not before one of his credit card companies cancelled his card due to my filing.

        My Dad is aware of my filing beforehand, so my bankruptcy is no suprise. I do not want his credit, credit cards, savings, etc affected unduly because of this.

          Yes, it does. I am still fustrated with my lawyer concerning that. I guess I just need to exercise due diligence with him.

            I see 'Sumoboy'. I know of people who are the III and IV and I don't know why the Credit bureau does not use SS numbers. If you google yourself you will find hundreds of people with your name. In your case, I would get on that lawyer and explain what he has caused to happen to your Dad and in no uncertain terms explain that he (your lawyer) should not be sloppy again. 'Hub

              I just checked pacer to see if the lawyer sent an amended document. It's there!!!

                I still have some problems with my name showing up in PACER. I had followed up, and my lawyer submitted my name correctly, BUT one of the documents had my first and middle names switched.

                This is becoming more of pain.

                  If your SS # is on that document and that is correct, probably the name issue won't be a problem, as long as it is a minor list, and not one of the major documents. If you check Pacer later on and do a search on the document summary, you'll get a listing of all the document titles, and notations telling what has been going on in the background.

                    You had better check with the creditor who listed your BK on your dad's credit reports because there could be an SS number issue involved as to the creditor. Credit reporting agencies report what is given to them by the creditors. Your full name not listed on your BK filing should not cause a BK to appear on your father's credit reports....check any creditor/source that provided that information to the CRA that is reporting it.

                      The creditor did not post the bk info on his credit report. One of the CRAs did. The creditor must have pulled Dad's credit report and saw the incorrect filing, I believe.
