    After Bankruptcy Discharge

    Hello, we were discharged from Chapter 13 bankruptcy nearly 2 years ago. Now one of the creditors is trying to place a lien on our bank account account for 1019.00 (New Century Finance). Our bankruptcy debt (8,932.00) to New Century was paid. I have a discharge letter from our Trustee. This predatory debt collector now says a lien will be placed on our bank account. Can someone please tell me what should I do?? I have a sneaky feeling these predators know that the Stimulus checks are coming and are taking advantage of fhis. Any advise? My bankruptcy attorney has moved into another area of practice now.

    Send them a copy of your discharge, the matrix showing that they were included in your filing. Along with a picture of your hand flipping the bird.

      ROFL!!! Ditto!!!

      They're trying to trick you into paying this discharged debt. Don't fall for it.

          I would trot right down to the court house and file a counter suit in small claims for 1000.00 for violating the auto stay that was placed on this debt with your discharge. Plus court costs of course. And I would let the trustee's office that serviced your case know the situation as well.

            After our discharge, our wonderful attorney throughout the entire 13 process for us sent us a letter that in the event any creditor discharged in the Chapter 13 tried to collect on the discharged debt, to contact him immediately, along with a long list of other instructions as to what to do after discharge. Some creditors try to play on hopefully someone's lack of knowledge after discharge and try to collect. Send to that creditor via Certified Mail a copy of your discharge, a copy of the creditor matrix showing the creditor was discharged in the BK, copy your attorney and copy the Trustee for some added drama for the creditor. In your letter state that any further harrassement from them will be turned over to your attorney and they should immediately correct their records. The other poster's suggestion of the xerox "bird" copy is fabulous be sure not to send that copy to the attorney or Trustee!

              I can't thank you all enough for your help and encouragement. I am going to the County court house tomorrow first thing armed with my papers. Thank you for the additional info on advising the Trustee - that was something I did not think of. My BK attorney, unfortunately, I cannot even locate. I never even received any information on the steps to take after discharge from our BK attorney. Last year and this year again, we tried to renew our vehicle registration only to be stopped by the motor vehicle. They had to call the State office before they would give us a renewal. We tried to straighten this motor vehicle problem out last year and was unsuccessful. I had not idea this Pressler and Pressler would stoop so low to try again.
              Thank you for all of your help. I feel like I have an army behind me.
